Submitted on Briefs: January 31, 2002 ¶1 The Petitioner, Robert J. Robbins, filed a petition for post-conviction relief in the District Court for the Eighth Judicial District in Cascade County. The District Court denied the petition based on its conclusion that State v. LaMere, 2000 MT 45, 298 Mont. 358, 2 P.3d 204, did not retroactively apply to Robbins' petition. Robbins appeals from the District Court's denial of his petition. We reverse the District Court and remand for a new trial. ¶2 We find the following issue dispositive:
